If I file an answer with the court, will I have a chance to talk to the Commissioner?

Yes. If you respond to the Summons and Complaint and disagree by filing an answer, you will be given a court date.


Is my child support case open to the public?

No.  Child support case information is confidential, and not open to the public.  However, documents in court files or county recorder files may be public record.


Is there any way to avoid having to go to court?

Yes.  You can avoid going to court by signing a legal agreement (stipulation).  The non-custodial parent and the Solano County DCSS can agree (stipulate) on the amount of child support if the custodial party is receiving welfare benefits.  If neither parent is receiving welfare benefits, then both parents may sign a legal agreement (stipulation) that establishes paternity and makes a formal arrangement to make child support payments.


The non custodial parent has group health insurance at work; must the child be covered under that insurance?

Yes. Health insurance must be included in any child support order. Even if it is not available immediately, the court will order the non-custodial parent to provide insurance when it does become available. This applies to all cases.


The non custodial parent is in jail. Can I get child support?

Unless the parent in jail has other assets or other income, child support will be nearly impossible to collect. A non-custodial parent who goes to jail should contact the Solano County DCSS to modify the child support order. Otherwise, child support will continue and the non-custodial parent will be responsible for paying past-due support when released.


What can I expect when I visit the Solano County Department of Child Support Services?

Solano County DCSS needs your help and cooperation to open a case. A Child Support Specialist will ask for information about you, your children, and the other parent. The more information the Child Support Specialist has, the faster a child support order can be obtained. When you open a child support case, the process to obtain child support begins.

Customer Connect is an exciting new service that allows parents, guardians, and others to get child support information 24 hours a day, 7 days a week.

What if a non-custodial parent forgets or ignores the summons and complaint?

A Proposed Judgment comes with the Summons and Complaint. The Proposed Judgment could be the order of the court if the non-custodial parent does not respond.


What is child support?

Child support is money paid toward a child’s living expenses and health insurance.



What is in a stipulation?

The stipulation contains the agreement that the non-custodial parent is:

B. Willing to pay child support
C. Willing to provide health insurance
D. Willing to allow the court to enter an order without appearing in court
