Commercial Cannabis
The Board of Supervisors adopted Ordinance No. 2018-1799 which permanently prohibits all commercial cannabis activities including commercial cultivation, distribution, manufacturing, testing, retail sales and other State recognized license types from being established in unincorporated Solano County.
There is no prohibition on the delivery of commercial adult-use or medical-use cannabis or cannabis products to a consumer in the unincorporated areas of Solano from a retailer licensed for delivery and located in a city or county that allows such businesses.
Personal-Use Cannabis Cultivation
The Board of Supervisors adopted Ordinance No. 2017-1788 to allow non-commercial cannabis cultivation (personal cultivation) by patients, their caregivers and by recreational users.
What is Personal-Use Cannabis Cultivation?
Personal cultivation: any activity involving the planting, growing, harvesting, drying, curing, grading, trimming, or otherwise processing of marijuana plants or any parts for personal use only.
Who can Cultivate Personal-Use Cannabis?
Medical: Any patient or caregiver with a medical recommendation for medical cannabis.
Adult-Use: Any person 21 years and older.
This cannabis CANNOT be sold to others.
How many Personal-Use Cannabis Plants are Allowed?
Medical Cannabis: Up to 6 plants or 12 immature plants, per residence
· A caregiver may grow up to 6 mature or 12 immature plants per patient for up to 5 patients.

Adult-Use Cannabis: Up to 6 plants, per residence.
Where can Personal-Use Cannabis Cultivation take place?
Indoor cultivation of cannabis for personal use in compliance with MAUCRSA (Medical Marijuana Regulation and Safety Act) is allowed in the unincorporated County in compliance with state law and County Ordinance No. 2017-1788:
· Must be indoors; in a residence or in an accessory structure located on the same parcel as the residence.
· The residence on the property must be inhabited by the person growing the cannabis.
· A greenhouse is defined as “indoors” as long as it is made of rigid, see-through material with a locking door fully inclosing the cannabis.
· Cultivation and all processing activities (such as trimming) must occur in a locked room and away from children.
· Ozone generators and gas devices are not to be used in the cultivation room.
· No open flame or burning is allowed in the cultivation room.
· Grow lights must be shielded as to not be visible from outside or turned off between 9:00 p.m. and 6:00 a.m.
Exception for Personal-Use Cultivation of Outdoor Medicinal Cannabis
Outdoor Cultivation may be permitted for up to three (of the six) medicinal cannabis plants upon approval of an Exception Request by the Department of Resource Management. Industrial Hemp
Industrial hemp is defined as a Cannabis sativa L. plant containing more than 3/10th of 1% of THC (Cal. Health & Safety Code §11018.5). Please contact the Solano County Agriculture Commissioner at (707) 784-1310 to discuss registration and cultivation requirements for industrial hemp.
